If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

You must be at least 13 years of age to use the Service. If you are under the age of 18, you must have the consent of a parent or legal guardian to use the Service. By using the Service, you represent and warrant that you meet these age requirements.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

avfile.io provides a free, browser-based file sharing service that allows users to upload, store temporarily, and share files via unique download links. The Service includes the following features:

• File upload and temporary storage on Cloudflare R2 object storage
• Generation of unique, shareable download links for uploaded files
• Optional password protection for file downloads
• Configurable file retention periods (24 hours to 7 days) with automatic deletion
• Chunked upload system supporting files up to 2GB
• Download tracking and basic analytics
• Rate limiting and fraud detection to prevent abuse

The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, secure, or error-free. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any feature, database, or content, with or without notice.

You agree not to use the Service in any way that violates applicable laws or regulations, or that could damage, disable, or impair the Service or interfere with any other party's use of the Service. Specifically, you agree not to:

• Use the Service for any unlawful purpose or to promote illegal activities
• Upload files that contain malware, viruses, or other harmful code
• Attempt to gain unauthorized access to any portion of the Service, other accounts, or computer systems
• Use automated tools (bots, scrapers, etc.) to access the Service without our express permission
• Attempt to circumvent rate limits, storage limits, or other restrictions imposed by the Service
• Use the Service to send spam or unsolicited communications
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use the Service in any manner that could damage, disable, or impair the Service

We reserve the right to terminate or restrict your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users of the Service, or is otherwise objectionable.

You are solely responsible for the content of any files you upload to the Service. By uploading a file, you represent and warrant that:

• You have the legal right to upload and share the file
• The file does not contain any illegal content, including but not limited to child sexual abuse material, terrorist content, or content that promotes violence
• The file does not infringe on any third party's intellectual property rights, including copyright, trademark, or trade secret rights
• The file does not contain personal information of any third party without their consent
• The file does not contain malware, viruses, trojans, or any other harmful or destructive code
• The file complies with all applicable local, state, national, and international laws and regulations

We actively respond to valid DMCA takedown requests and reserve the right to remove any file that violates these rules without prior notice. The Service and its original content (excluding user-uploaded files), features, and functionality are and will remain the exclusive property of avfile.io and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of avfile.io.

You retain all ownership rights to the files you upload to the Service. By uploading a file, you grant avfile.io a limited, non-exclusive, non-transferable license to store, reproduce, and distribute the file solely for the purpose of providing the Service (i.e., making the file available for download via the unique link generated for that file). This license terminates automatically when the file is deleted from our storage in accordance with your chosen retention period or a manual deletion request.

We do not claim ownership over any user-uploaded content. We do not use, modify, adapt, or create derivative works from user-uploaded files except as necessary to provide the Service.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AVFILE.IO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL AVFILE.IO'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT PAID BY YOU TO AVFILE.IO DURING THE TWELVE (12) MONTH PERIOD PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you. In such cases, our liability shall be limited to the fullest extent permitted by applicable law.

You agree to defend, indemnify, and hold harmless avfile.io and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the Service, or your violation of any rights of another party.

This indemnification obligation will survive the termination of your use of the Service and these Terms. We reserve the right to assume exclusive defense of any matter subject to indemnification at our expense, and you agree to cooperate with our defense of such claims.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. We will notify you of material changes by posting the updated Terms on our website with a new "Last updated" date.

By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Service. It is your responsibility to review these Terms periodically.

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which avfile.io operates, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service.
